Indeminification, Jurisdiction and Language

You will hold findlocalbakers.com known as "FLB" and its parent company Oceanview Software LLC, owners, employees, affliates, investors, suppliers and associates harmless in all cases. By using the site you further agree to resolve any disputes directly with the LLC by talking with them in good faith to resolve your issue. As a last resort, you agree to file any legal procedings in the county of Miami-Dade in the State of Florida, USA. The english version of this document is the official version. We are not responsible for any errors due to translation into another language.

Use at your own risk

By logging into the system or using the system you agree to all rules and accept all warnings. You agree you are 18 years of age or older. You further agree that any of your information that you submit to the site, or is sent to you, is saved in the system. This data may also be provided to financial institutions in the event of a billing dispute or law enforcement if the LLC has reasonable belief that someone's safety is in danger or fraud was committed. This includes but is not limited to, personal information, financial account information, photos, messages, sms texts and emails.

Anyone can be banned for any reason. Ocean View Software, LLC d/b/a FLB and its owners, employees, contractors or affiliated people are not responsible to you for anything. Includeing, but not limited to your safety, lost wages, lost business, financial damages, computer/device damages, punitive settlements, travel expenses or any type of consideration. We do not do background checks or verify anyone on the site, you are responsible for your safety. We don't verify any government certifications for bakers. We cannot gurantee the safety of any food product. The creator, the baker, is solely responsible for their product. We do not have any relationship with them. We do not reccommend or endorse any baker, their product or their service. Its free to list here and open to anyone.

FLB is not responsible for these examples (and not limited to these examples):
1. late deliveries
2. products that don't meet your expectation
3. failure of a baker to provide products
4. failure of a customer to pay, or dispute charges, any type of payment scam
5. A member not cooperating to receive a delivery. Products cannot be delivered without cooperation from the recipient. The recipient may need to be home at a certain time or may need to go to a physical location to pick up a product.
6. A customer/baker not providing the correct address. This could cause your perishable product to spoil or not be delivered at all.

Code of Conduct

You are not allowed to use the site to post or send hate speech, harrasing or threatning language. You are not allowed to use the site in anyway to attack, bother, embarass or annoy someone. This includes pretending to be someone you are not.

No nudity is allowed on the site. No imagery from hate groups or terrorist organizations is allowed.

The site reserves the right to remove any content it finds objectional for any reason. You agree there is no recourse for you and FLB is not responsible for any loss or damages to you. This is private property and you will act in accordance with the LLC's code of conduct. If you do not agree, do not use the site. Mark your account inactive and do not return.

You agree the LLC has the right to hold your content in connection with hosting your profile or listing. This includes written words as well as pictures, videos or ideas. Anything you might insert or upload to the site. Once your data is in our system it may continue to exist after deleting it. It can also exists in backups for long periods of time. We recommend not sending information to other members that you would not want to share publicly. We cannot be responsible for members handling of your private or non-public information or data.

You are not allowed to use this site for fraudulent purposes. False pictures, false descriptions, false representations or false statments are not allowed. Trying to hack or cheat the payment system is not allowed. Trying to hack the site or gain access to information that does not belong to you is not allowed. If the LLC or any of its employees, representatives or affiliates believe you are involved in this type of activity you can be banned from the site, at our sole discretion. We also reserve the right to pursue legal action against you at our discretion. This includes cooperation with law enforcement and providing law enforcement any of your information or images. You agree you will be responsible for any legal cost necessary to deal with your actions. This includes if your actions are found to be legal or illegal by a court of law. We also reserve the right to give out your information to someone who wants to pursue legal action against you, if and only if the situation is extremly significant and the LLC feels the situation is a threat to our business or the safety of one of our members in an imminent and clear way. "Threat to our business" includes defaulting on purchase transactions.

Any sales are between the seller and buyer. FLB does not serve as judge or settle disputes. From our perspective we do expect members to act in good faith to maintain their active account here. We reserve the right to intervene or adjust financial transactions only in very rare situations. Not filling an order and not refunding the customer or a customer ordering and not paying or a customer revoking payment without due notice is not the responsibility of FLB. We don't make people "whole" or fix transactions. Only the buyer and seller are responsible for law enforcement. We are not a party to any litigation from transactions on the site. If an order is started you may need to pay for lost time/materials. Some orders may not be cancelable. A customer cannot expect to cancel at anytime and receive all their money back. Refer the the sellers "cancel" or "refund" policy.

FLB does not endorse, stand behind or gurantee any transaction on the website.
